Environmental Liability Risk Assessments
The Environmental Liability Directive (2004/35/EC) as amended aims to prevent and remedy environmental damage and to reinforce the ‘polluter pays’ principle, making an operator that causes environmental damage legally and financially liable for the damage caused and the subsequent remediation.
The EPA terms ‘unknown liabilities’ as liabilities that may arise due to accidents or unforeseen events. It is important from a licensee’s point of view that these liabilities are credible and reasonable, and it is important from the EPA’s point of view that financial instruments, such as insurance, are in place to cover those liabilities identified. For such reasons Environmental Liability Risk Assessment (ELRA) are undertaken.
